STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Ten
AN ACT relative to the deposit of weekly rental payments by a tenant during an eviction proceeding.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Actions Against Tenants; Payment of Rent Pending Eviction Proceeding. Amend RSA 540:13, II(a) and (b) to read as follows:
(a) If the tenant wishes to contest the eviction, he or she must file an appearance in the district court no later than the return day appearing on the writ and shall pay to the court, on a weekly basis with the first payment due upon the filing of the appearance, all rent, as it becomes due between the date of filing the appearance and the date of the final order.
(b) The tenant shall not be evicted unless the court so orders; however, such an order may be granted if the tenant does not file an appearance or does not pay rent as provided under subparagraph (a).
2 Repeal. RSA 540:2, VI, relative to permitting payment of utilities in lieu of rent in certain cases, is repealed.
3 Effective Date. This act shall take effect January 1, 2011.

Bill Davidson Nashua I strongly support this bill! The current eviction system allows abuse by the tenant, unfairly restricting the landlord's legal process.
Maria E. Gortney - We need help to pay our expenses while occupied by another party. during a eviction process, beside the landlord always encures more expense like damage, advertizing, cleaning , loss rent, time. etc. wont be so easy to be taken advantage off. we need more help from the law. we have tried harder , but we are always the victum.
Maurice Goyette Belmont I support this bill
heather reyor winchester Land lords need this!!! Great!
Donald E. Cummings Londonderry, NH Protecting landlords will facilitate more and better quality rental options throughout the state.

Tenant biased laws increase risk to the landlord, pushing people away from investing in new properties.

Fawn M. Gobis Manchester, NH I support this bill. Glad to see support for Landlords and hopefully eliminate the tenants who abuse and take advantage of the legal system!
Shawn Wayman Laconia, NH -
wm drew gilford nh I support this bill. Too many tenants take advantage of the current system which allows them up to 3 months to live rent free if they "play the game" properly. Then when you attempt to collect the back rent, the claim of "inadequate funds" or "financial hardship" leaves the landlord with nothing! It is long overdue...
Barbara Lee Augusta Manchester We need this! It is fair to everyone.
Susan Hare Tilton -
shafiq chaudhry Franklin, NH I support HB 1413.
William Eckert Claremont NH I hope this is the beginning of more recognition for landlord rights. We provide a resource for our communities, the communities should offer landlords this and other means to protect our income and property.
Bob &Sheri Vigneault Manchester, NH We support this bill. We need more rights to help us not get in a deeper hole financially as these tenants get to ride it out on our pocketbook & usually leave us with loss of rent & damage to apt.'s.

Axel Boldu Manchester,NH I support this bill.
Robert M. Meegan Rollinsford NH This is long overdue! I had a tennant who due to the holidays and Ct delays owed me about $3500.00 before being evicted. Courts are little help. This bill will shorten the numbers using Ct delays.
hubert buchanan amherst nh Renters can at present live free at the expense of the property owner until the court returns possession to owner.
